Article 1 – Definitions
In these conditions, the following terms shall have the following meanings:
Entrepreneur: JBP Hobbyhorsing, the entity offering products and services remotely.
Consumer: The natural person who is not acting in the course of a profession or business and who enters into a distance contract with the Entrepreneur.
Distance Contract: An agreement concluded between the Entrepreneur and the Consumer within the framework of an organized system for distance selling of products and/or services, without the simultaneous physical presence of the Entrepreneur and the Consumer.
Cooling-off Period: The period within which the Consumer can make use of their right of withdrawal; 14 calendar days.
Right of Withdrawal: The Consumer’s option to cancel the distance contract within the cooling-off period.
Product: Any good offered on the JBP Hobbyhorsing website, including hobbyhorses and accessories.
Commission: A Product created by the Entrepreneur according to the Consumer’s specifications.
Event: A JBP Concours or other activity organized by the Entrepreneur on a specific date.

Article 3 – Applicability
These general terms and conditions apply to every offer from the Entrepreneur and to every distance contract concluded between the Entrepreneur and the Consumer.
Before the contract is concluded, the text of these general terms and conditions will be made available to the Consumer electronically in such a way that it can be easily stored.
Article 4 – The Offer
The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable a proper assessment of the offer by the Consumer.
All JBP Hobbyhorsing products are unique and handmade with great care and love. Due to this artisanal process, minor variations in color, size, material, and detail may occur compared to the product images. These variations are a testament to the unique character of each item and are not considered defects.
Images are a true representation of the products offered. However, the Entrepreneur cannot guarantee that the displayed colors exactly match the real colors of the products.
Obvious mistakes or errors in the offer do not bind the Entrepreneur.
Article 5 – The Agreement
The agreement is concluded at the moment the Consumer accepts the offer and complies with the corresponding conditions, which includes the completion of the payment process.
The Entrepreneur will immediately confirm receipt of the acceptance of the offer by electronic means (e-mail).
The Entrepreneur reserves the right to refuse an order or to attach special conditions to the execution, for example, in case of suspected resale or previous non-payment.
Article 6 – Right of Withdrawal (for standard products)
When purchasing standard (non-customized) products, the Consumer has the right to dissolve the agreement without giving any reason during a period of 14 days. This cooling-off period starts on the day after the Consumer receives the product.
During the cooling-off period, the Consumer will handle the product and its packaging with care. The product may only be inspected to the extent necessary to assess whether the Consumer wishes to keep it. Use beyond inspection is not permitted.
To exercise the right of withdrawal, the Consumer must inform the Entrepreneur within the 14-day period by means of an unambiguous statement (e.g., by e-mail). After notification, the Consumer has another 14 days to return the product.
Article 7 – Costs in Case of Withdrawal
If the Consumer exercises their right of withdrawal, the direct costs of returning the product are for the Consumer’s account.
The Entrepreneur will refund the purchase amount, including the initial shipping costs, as soon as possible but no later than 14 days after receiving the notification of withdrawal. The Entrepreneur may wait with a refund until the product has been received back, or until the Consumer has provided proof of return shipment.
The Consumer is liable for any diminished value of the product resulting from handling that goes beyond what is necessary to establish the nature, characteristics, and functioning of the product.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal is excluded for:
a. Custom Orders (Commissions): Products manufactured according to the Consumer’s specifications, which are clearly personal in nature.
b. Event Tickets: Registrations or tickets for participation in the JBP Concours or other leisure activities to be performed on a specific date or during a specific period.
Article 9 – The Price
All prices stated in the offer of products or services are in Euros (€) and include VAT.
Prices do not include shipping costs. These are calculated and displayed during the checkout process.
For orders shipped outside the European Union, the Consumer is responsible for any import duties, taxes, and customs fees that may be levied by the destination country.
Article 10 – Conformity and Warranty
The Entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability, and the legal provisions existing on the date of the conclusion of the agreement.
A defect in a product must be reported to the Entrepreneur within a reasonable period after its discovery. A report within two months of discovery is in any case considered timely.
The warranty does not apply if:
a. The defect is caused by normal wear and tear.
b. The Consumer has repaired or modified the product themselves or has had it repaired or modified by third parties.
c. The product has been exposed to abnormal conditions (e.g., left outside in the rain, stored improperly) or has been handled carelessly or contrary to the Entrepreneur’s instructions.
Article 11 – Delivery and Execution
The Entrepreneur will take the greatest possible care when receiving and executing orders.
The place of delivery is the address that the Consumer has made known to the Entrepreneur.
Stated delivery times (e.g., 2-3 weeks for Commissions in the Netherlands) are indicative. No rights can be derived from these periods. Exceeding a delivery time does not entitle the Consumer to compensation.
The risk of damage and/or loss of products rests with the Entrepreneur until the moment of delivery to the Consumer, unless expressly agreed otherwise.
Article 12 – Payment
Payment must be made using one of the payment methods indicated during the ordering process.
For Commissions, production will only start after the full agreed-upon amount has been paid by the Consumer.
Article 13 – Complaints Procedure
The Entrepreneur has a sufficiently publicized complaints procedure and handles complaints in accordance with this procedure.
Complaints about the execution of the agreement must be submitted to the Entrepreneur fully and clearly described, preferably by e-mail.
Complaints submitted to the Entrepreneur will be answered within a period of 14 days from the date of receipt.
Article 14 – Custom Orders (Commissions)
A Commission is created based on the specifications (including photos and descriptions) provided by the Consumer.
The Entrepreneur provides a quote based on the requested specifications. The agreement for a Commission is concluded upon the Consumer’s acceptance of the quote and full payment thereof.
As stated in Article 8, Commissions are excluded from the right of withdrawal and cannot be returned or refunded.
The Entrepreneur retains creative freedom and will not produce exact copies of hobbyhorses made by other artists. The final design will be inspired by the Consumer’s wishes but will remain a unique JBP Hobbyhorsing creation.
Article 15 – JBP Concours (Events)
Registration for an Event is final only after a ticket has been purchased and paid for through the webshop. The order confirmation serves as the entry ticket.
As stated in Article 8, tickets for Events are non-refundable.
If the Entrepreneur is forced to cancel an Event, all registered participants will receive a full refund of the ticket price.
Participation in any Event is entirely at the Consumer’s own risk. The Entrepreneur is not liable for any personal injury, loss, or damage to property.
Participants must follow all rules and instructions given by the Entrepreneur or event staff. Failure to do so may result in exclusion from the Event without a refund.
By participating in an Event, the Consumer grants the Entrepreneur permission to use photos and videos taken during the Event, in which the Consumer may be visible, for promotional purposes on its website and social media channels.
Article 16 – Intellectual Property
All designs, products, images, texts, and other content on the JBP Hobbyhorsing website and social media channels are the intellectual property of the Entrepreneur. They may not be copied, reproduced, or used for commercial purposes without prior written permission.
Article 17 – Liability
The liability of the Entrepreneur is limited to the purchase price of the product or service in question, except in cases of intent or gross negligence on the part of the Entrepreneur.
Article 18 – Age and Consent
JBP Hobbyhorsing primarily targets children and young adults. We assume that Consumers under the age of 18 have obtained permission from a parent or legal guardian to make a purchase.
By accepting these terms and conditions, the Consumer confirms that they are either 18 years of age or older, or have the required parental/guardian consent.
Article 19 – Disputes
Contracts between the Entrepreneur and the Consumer to which these general terms and conditions apply are exclusively governed by Dutch law.
The Vienna Sales Convention is not applicable.
